Joint Conference with NYU Law Celebrates Prof. Robert Post’s Book on the Taft Court, Opening Remarks
April 20th, 2024
The Taft Court: Making Law for a Divided Nation, 1921-1930, the latest book by Sterling Professor of Law Robert C. Post ’77, will be the focus of a jointly held conference at NYU Law on April 20.
The event, “The Long 1920s: Robert Post’s Oliver Wendell Holmes Devise History of the Taft Court” and held in partnership with the Law School, featured two panel discussions as well as a keynote conversation between Post and Professor John Fabian Witt ’99.
Panelists included Mark Tushnet ’71 of Harvard Law School, Laura Kalman of UC Santa Barbara, Lisa McGirr of Harvard University, Rick Hills ’91 of NYU Law, Noah Rosenblum ’17 of NYU Law, Beverly Gage of Yale University, Daniel Ernst of Georgetown Law, and Sophia Lee ’06 of Penn Carey School of Law.
The Taft Court outlines the definitive history of the U.S. Supreme Court under Chief Justice William Howard Taft and is the 10th volume of the Oliver Wendell Holmes Devise History of the Supreme Court of the United States. Originally assigned to two other Law School faculty beginning in 1955, both died before completing the project. Post began work on the volume nearly 35 years ago.
At the Law School, Post specializes in constitutional law with a particular emphasis on the First Amendment. He is a member of the American Law Institute and a fellow of both the American Philosophical Society and the American Academy of Arts and Sciences. He served as the Law School’s 16th dean from 2009 to 2017.

    Naturally Maimonedes had a very different view than the Rabbis before him because he was heavily influenced and absorbed the Islamic point of views.. as he was born , grew up and lived in Muslim countries and had Islamic educations throughout his life and even attended Islamic religion schools n the Golden age of islam , all those elements enriched him immensely in helping his understandings and unfolding his views of the Torah in a different way..

      Glad to see someone "gets it." We have been infiltrated by foreign agents of the "Crown", and our US courts are standing on Admiralty/Maritime jurisdictions, this is fraud. Under Admiralty jurisdiction there MUST be an International contract and that contract MUST be in breach. Defendants are tricked into unknowingly giving consent to this charade, as they have never consented nor entered into to ANY international contract, so how how can there be a breach if NO contract exist? The courts trick the defendant into giving consent thru different means to stand under their Admiralty jurisdiction......... all a sham. If a bar member were to raise this question, I am confident they would be dis-barred in a heartbeat.😁 (I have a more detailed argument/explanation concerning this, but would take up a whole page.}

    "The idea prevails with some, indeed it has expression in arguments at the bar, that we have in this country substantially two national governments; one to be maintained under the Constitution, with all its restrictions; the other to be maintained by Congress outside and independently of that instrument, by exercising such powers as other nations of the earth are accustomed to... I take leave to say that, if the principles thus announced should ever receive the sanctions of a majority of this court, a radical and mischievous change in our system will result. We will, in that event, pass from the era of constitutional liberty guarded and protected by a written constitution into era of legislative absolutism... It will be an evil day for American Liberty if the theory of a government outside the Supreme Law of the Land finds lodgment in our Constitutional Jurisprudence. No higher duty rests upon this court than to exert its full authority to prevent all violation of the principles of the Constitution." Honorable Supreme Court Justice John Marshall Harlan - in the 1901 case of Downes v. Bidwell, 182 U.S. 244. Next to revenue (taxes) itself, the late extensions of the jurisdiction of the admiralty are our greatest grievance. The American Courts of Admiralty seem to be forming by degrees into a system that is to overturn our Constitution and to deprive us of our best inheritance, the law of the land. It would be thought in England a dangerous innovation if the trial, of any matter on land was given to the admiralty" Jackson v. Magnolia, 20 How. 296 315, 342 (U.S. 1852)

    Slave owners created USA for the purpose of wealth hoarding, slave owning and for unlimited expansion in imperialism and Empire building. For the First Amendment enshrined the State Religion established in the Deceleration of Independence as a fake morality to establish an intelligence dictatorship. For most everyone strives to enrich themselves upon the misery of those with less education, less wealth or less whiteness of skin. For Empire USA has always allowed the educated upper-half of society to own all the land, wealth, political power and healthcare, turning my slow and careful thinking laboring-class into the 50% working poor.
